Terms & Conditions

Please read these terms carefully before using FortressDrive. By using the Platform, you agree to be bound by these terms.

1. Acceptance of Terms

By accessing or using FortressDrive (the "Platform"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, you must not access or use the Platform.

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and FortressDrive ("we," "us," or "our"). We reserve the right to modify these Terms at any time, and your continued use of the Platform constitutes acceptance of any changes.

You must be at least 18 years old or the legal age of majority in your jurisdiction to use this Platform.

2. Description of Services

FortressDrive is a privacy-first Personal Operating System that provides the following encrypted modules and services:

• Encrypted Notes — AES-256-GCM encrypted note-taking with folder organization and zero-knowledge storage.

• AI Assistant — A premium AI powered by o3 and GPT-4o with vision, document analysis (PDF/DOCX/CSV/Excel), DALL·E 3 image generation, Whisper voice input, and web search. Conversations are never used for training.

• My Drive — Up to 1 TB of encrypted cloud storage powered by Cloudflare's R2 network. Files are AES-256 encrypted, support chunked uploads for large files, image thumbnails, and a 30-day trash.

• Crypto Wallet — Multi-chain self-custody wallet (Ethereum, Bitcoin, Solana, Tron, BNB Chain) with AES-256 encrypted private keys, automatic ERC-20 / BEP-20 / TRC-20 / SPL token detection, in-app swaps (Uniswap / Jupiter), and 3FA-protected transactions.

• Password Vault — AES-256-GCM encrypted credential storage behind a dedicated security gate.

• Goals & Projects — Encrypted goal tracking with Gantt timelines, progress bars and PIN-protected access.

• Journal — Encrypted private journal with activity heatmaps and mood tracking.

• Business Reports & Personal Expenses — Encrypted dashboards for investments, loans, expenses, revenue, contracts and partnerships with full counterparty, ROI and interest tracking.

• Debts & Loans + Repayment Tracking — Track principal, interest, total due and a running ledger of every individual repayment.

• Subscriptions & Auto-Renewal — Tiered plans paid in crypto (ETH/SOL/TRX/USDT) or in NGN/card via Paystack, with optional auto-renewal, saved cards, and dunning notifications.

• Support Tickets — Encrypted in-app support channel with our team, including priority levels and read receipts.

• Account Recovery — Identity-verified recovery flow for lost 2FA access, with encrypted ID storage.

• Business Workspaces — Shared multi-tenant workspaces with roles (Owner / Admin / Member / Viewer), pooled storage and AI quota, branded share links, full audit logs, required-2FA, forced session timeouts, domain-locked sharing, DLP rules, and on the Enterprise tier: SAML 2.0 SSO, SCIM 2.0 provisioning, Bring Your Own Key (BYOK) encryption, custom data residency and a 99.99% uptime SLA.

All modules are protected by our multi-layer security architecture, including three-factor authentication (3FA), per-module security gates, and AES-256-GCM encryption.

3. Account Registration & Security

To use the Platform, you must create an account by providing accurate and complete registration information. You are responsible for maintaining the confidentiality of your account credentials.

Password Requirements: Your password must be at least 12 characters long and include uppercase letters, lowercase letters, numbers, and symbols. We enforce strict password complexity to protect your account.

Three-Factor Authentication (3FA): FortressDrive uses a three-layer authentication system consisting of your password, a TOTP authenticator app, and device/IP verification. We strongly recommend enabling all three factors.

Module Security Gates: Individual modules can be protected with separate PIN codes, providing an additional defense layer even if your main account is compromised.

You are solely responsible for all activity that occurs under your account. You must immediately notify us of any unauthorized access or security breach.

4. Zero-Knowledge Architecture & Encryption

FortressDrive operates on a zero-knowledge architecture. This means:

• Sensitive data including files, credentials, and wallet keys is encrypted using AES-256-GCM before storage.

• Encryption keys for critical modules (Vault, Drive, Crypto Wallet) are derived from your credentials.

• Certain modules utilize server-side encryption where data is encrypted at rest on our servers.

• The AI Assistant processes requests through third-party APIs (OpenAI) — conversations are transmitted securely but are processed externally to generate responses.

IMPORTANT: For modules using client-derived encryption keys, if you lose your account password and do not have recovery options configured, your encrypted data cannot be recovered by anyone, including us. You are solely responsible for maintaining access to your credentials and any backup recovery methods.

5. Subscription Plans & Payments

FortressDrive offers tiered subscription plans with varying levels of access:

• SHIELD (Free) — Basic access with limited features.

• FORTRESS ($12/month) — Enhanced features and storage.

• SOVEREIGN ($29/month) — Premium access with advanced modules.

• DOMINION ($79/month) — Full access with up to 1 TB encrypted cloud storage.

Payments are processed through direct cryptocurrency wallet transfers. We accept ETH, USDT (ERC-20), SOL, TRX, and USDT (TRC-20). Payment confirmations are verified on-chain.

Subscription billing is on a monthly cycle starting from your payment confirmation date. Failure to renew may result in downgrade to the free tier. Your encrypted data will remain stored but access to premium features will be restricted.

We do not offer refunds for partial billing periods. You may cancel your subscription at any time, and access will continue until the end of the current billing period.

6. Crypto Wallet Services

FortressDrive provides self-custody crypto wallet functionality. You are the sole custodian of your private keys.

• Private keys are AES-256 encrypted and stored within your encrypted vault.

• Sending funds requires full 3FA verification (password, TOTP authenticator, and device confirmation).

• We support multiple blockchains including Ethereum, Solana, Tron, and Bitcoin.

DISCLAIMER: FortressDrive is not a financial institution, exchange, or custodial wallet service. We do not hold, manage, or have access to your crypto assets. We are not responsible for any losses resulting from blockchain transactions, market fluctuations, incorrect wallet addresses, or network fees. All transactions are final and irreversible once confirmed on the blockchain.

You acknowledge that cryptocurrency transactions carry inherent risks and that you are solely responsible for verifying transaction details before confirmation.

7. Cloud Storage (My Drive)

FortressDrive provides encrypted cloud storage powered by Cloudflare's R2 global network, with storage limits determined by your subscription tier.

• All files are AES-256 encrypted on the server side before upload to cloud storage.

• Files are protected by two-layer access gates in addition to your account authentication.

• Storage limits are enforced per your subscription plan. Exceeding your storage quota will prevent new uploads until space is freed or your plan is upgraded.

We do not inspect, scan, or analyze the content of your encrypted files. You are solely responsible for the content you store and must comply with all applicable laws in your jurisdiction.

Prohibited content includes but is not limited to: content that violates any law, content related to exploitation of minors, and content that infringes on intellectual property rights.

8. AI Assistant Usage

The AI Assistant is powered by third-party language models (OpenAI o3 and GPT-4o) and operates within your encrypted environment.

• Your conversations with the AI Assistant are not used for model training.

• Conversations are sent to OpenAI's API for processing through encrypted channels and are not retained by OpenAI beyond the processing window.

• The AI Assistant provides general information and should not be relied upon as professional advice (legal, medical, financial, or otherwise).

AI usage limits may apply based on your subscription tier. We reserve the right to implement fair usage policies to ensure service quality for all users.

We are not liable for any decisions or actions you take based on AI Assistant responses.

9. Prohibited Activities

You agree not to use the Platform for any unlawful purpose or in any way that could damage, disable, or impair the Platform. Prohibited activities include:

• Using the Platform to store or distribute illegal content.

• Attempting to breach, circumvent, or test the security of the Platform without authorization.

• Reverse engineering, decompiling, or disassembling any part of the Platform.

• Using automated tools, bots, or scripts to access the Platform in an unauthorized manner.

• Sharing your account credentials with third parties or allowing unauthorized access.

• Attempting to access other users' data or accounts.

• Using the Platform to conduct any form of fraud or money laundering.

Violation of these terms may result in immediate account suspension or termination without notice.

10. Data Ownership & Portability

You retain full ownership of all data you create, upload, or store on FortressDrive. We claim no ownership rights over your content.

You may export your data at any time through the Platform's export functionality. We do not impose vendor lock-in.

Upon account deletion, all your encrypted data will be permanently and irreversibly removed from our servers within 30 days. This action cannot be undone.

Because of our zero-knowledge architecture, we cannot access or provide your data to any third party, including law enforcement, without your explicit cooperation and decryption.

11. Service Availability & Limitations

We strive to maintain 99.9% uptime (99.99% on the Business Enterprise tier under a separate SLA) but do not guarantee uninterrupted access to the Platform. The Platform may be temporarily unavailable due to:

• Scheduled maintenance (we will provide advance notice when possible).

• Emergency security patches or updates.

• Circumstances beyond our reasonable control (force majeure).

We are not liable for any losses or damages resulting from service interruptions.

Inactivity Auto-Lock: Sessions automatically lock after 5 minutes of inactivity for your security. This is a non-configurable security feature on personal accounts; Owners of a Business workspace can configure their own session timeout for that workspace's members.

12. Data Backups & Data Loss Disclaimer

We run automated daily encrypted backups of our production database with 30-day retention and continuous health monitoring. These backups are operational disaster-recovery snapshots used by us to restore service in the event of a platform incident — they are not a substitute for your own backups of important data.

IMPORTANT — DATA LOSS: TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTRESSDRIVE IS NOT LIABLE FOR ANY LOSS, CORRUPTION, OR INACCESSIBILITY OF YOUR DATA, INCLUDING BUT NOT LIMITED TO LOSS RESULTING FROM:

• Forgotten passwords, lost TOTP devices, missing email login codes, or any other access credential you fail to retain.

• Loss of locally-derived encryption keys or per-folder / per-module passcodes that we cannot recover by design.

• Your own actions or those of any user you authorize (including team members, admins, or owners in a Business workspace) — including accidental deletion, intentional deletion, emptying of trash, account closure, or destructive automation.

• Failed third-party services we depend on (cloud storage providers, blockchain networks, email providers, payment processors, OAuth providers, KMS/BYOK providers).

• Hardware failure, network outages, force-majeure events, regulatory seizure, or any incident outside our reasonable control.

• Restoration from a backup snapshot, which by its nature represents the state of the database at the time the snapshot was taken; any changes made between that snapshot and the restore point will be lost.

• Permanent deletion of trashed items after the 30-day grace window, or permanent deletion of all account data within 30 days of account closure.

• Misconfiguration of Bring-Your-Own-Key (BYOK) encryption keys, including revocation or loss of the customer-controlled key material, which renders affected data unrecoverable by us by design.

BACKUP RESPONSIBILITY: You are solely responsible for maintaining your own independent backups of any data whose loss would be material to you. The Platform provides export functionality (file downloads from My Drive, note exports, wallet seed-phrase backups, journal exports, and CSV/JSON exports for finance modules). You agree to use these export tools regularly and to store the exports somewhere outside of FortressDrive.

NO RECOVERY OBLIGATION: We have no obligation to recover, reconstruct, or compensate for any lost data and offer no guarantee that any particular piece of data can be restored from backups. Where restoration is technically possible, we may at our discretion attempt a best-effort recovery for paying users on a time-and-materials basis, but no result is guaranteed.

CRYPTO ASSETS: Loss of crypto-wallet seed phrases or private keys is permanent and irreversible. We cannot recover crypto assets under any circumstances. You are the sole custodian. See Section 6 for further wallet-specific disclaimers.

13. Business Workspaces

Business workspaces are separate, shared tenants from personal accounts. Data created inside a workspace (files, notes, AI conversations, settings, audit logs) is owned by the workspace, not by any individual member.

Workspace Owners and Admins have the ability to modify, share externally, or permanently delete workspace data, and to suspend or remove members. By joining a workspace you acknowledge and accept that other authorized members may take destructive actions on shared data. FortressDrive is not responsible for damages caused by an Owner, Admin, or any member acting within their granted role.

Pooled Resources: storage capacity, AI message quota, and seat count are pooled across the workspace at the workspace tier (Starter / Growth / Enterprise). Exceeding a quota may degrade or temporarily disable features for all members until the quota is reset, expanded, or the relevant data is removed.

Audit Logs: workspaces record member actions in an immutable audit log for security and compliance. Owners and Admins (and Growth/Enterprise tiers via CSV export) can view this log. By using a workspace you consent to such logging.

Required Security Policies: Owners may require all members to enable 2FA and may enforce a maximum session timeout. Failing to comply will prevent workspace access until the requirement is met.

Domain-Locked Sharing & DLP: Owners on Growth and Enterprise tiers may restrict external sharing to verified company domains and configure Data Loss Prevention rules. FortressDrive provides these as configurable tools and is not liable for losses arising from misconfiguration.

SSO, SCIM, BYOK (Enterprise): Where Enterprise customers enable SAML 2.0 SSO, SCIM 2.0 provisioning, or Bring Your Own Key encryption, the customer remains responsible for the configuration, availability, and integrity of those external systems. We are not liable for downtime, lockouts, provisioning errors, or data loss caused by failure of customer-controlled identity providers, SCIM endpoints, or KMS keys.

Billing: workspace subscriptions are billed separately from personal subscriptions and are charged to the Owner. Adding or removing seats may result in immediate prorated invoicing.

Termination: removal of a member, downgrade of the workspace tier, or non-payment may result in loss of access to workspace data for affected members; the data itself remains the workspace's property until the workspace is closed.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORTRESSDRIVE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Any loss, corruption, or inaccessibility of your data, however caused (see Section 12 for the full data-loss disclaimer).

• Financial losses from cryptocurrency transactions, market fluctuations, slippage, swap routing, gas / network fees, or wallet-address errors.

• Damages resulting from unauthorized access to your account due to your failure to maintain credential, device, or 2FA security.

• Any losses arising from reliance on AI Assistant responses.

• Damages caused by other members of a Business workspace acting within their granted role (Owner / Admin / Member / Viewer).

• Damages arising from third-party services we depend on, including but not limited to Cloudflare R2, OpenAI, Paystack, blockchain networks, RPC providers, SSO identity providers, SCIM endpoints, and customer-controlled KMS / BYOK keys.

Our total aggregate liability for any claim arising out of or relating to the Platform shall not exceed the greater of (a) the amount you have paid us for the Platform in the twelve (12) months preceding the claim, or (b) USD $100.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.

15. Intellectual Property

All intellectual property rights in the Platform, including but not limited to software, design, logos, trademarks, and documentation, are owned by FortressDrive.

Your use of the Platform does not grant you any ownership rights in our intellectual property. You are granted a limited, non-exclusive, non-transferable license to use the Platform in accordance with these Terms.

You may not copy, modify, distribute, sell, or lease any part of the Platform without our prior written consent.

16. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in activities that harm the Platform or its users.

You may terminate your account at any time by contacting us or using the account deletion feature. Upon termination:

• Your subscription will be canceled immediately.

• Your encrypted data will be scheduled for permanent deletion within 30 days.

• Any remaining subscription period will not be refunded.

Provisions that by their nature should survive termination (including limitation of liability, intellectual property, and dispute resolution) shall survive.

17. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Any disputes arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration.

You agree to waive any right to participate in class action lawsuits or class-wide arbitration against FortressDrive.
